The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 354, 307, 452, 302, 325 of the Indian Penal Code.
It is a case of assaulting by all the F.I.R named accused persons including the petitioner to the informant, his father and other persons due to which, father of the informant succumbed to the injuries. It is submitted by learned counsel for the
Patna High Court CR. MISC. No.5690 of 2023(3) dt.09-05-2023 2/2 petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The specific accusation of assaulting to the deceased is against Binod Sharma and Sitaram Sharma. The petitioner is languishing in custody since 16.04.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Purnea in connection with Banmankhi P.S. Case No. 118 of 2022.
