JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have given one Dabiya blow causing injury on the head of the informant.
Contention on behalf of the petitioner is that the informant was brought to Sadar hospital Araria where the doctor advised him for some medicines as well as C.T. Scan and, after that, the C.T. Scan of the informant was done and no bone injury was found but, subsequently, the informant produced another C.T. Scan report of Katihar Medical College and the aforesaid report was challenged by the petitioner and, after that, medical board was constituted but informant did not appear before the medical board for his examination. It is further submitted that, as a matter of fact,

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Araria in connection with Jokihat P.S.Case No. 97 of 2015.
