JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 09-09-2021 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner in the present case is seeking regular bail in connection with Giriyak (Katrisarai) P.S. Case No.378/2020 registered for the offences punishable under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code and 66 of the I.T. Act. He is in custody since 13.10.2020.

Learned counsel for the petitioner submits that this petitioner is a shopkeeper. The allegation against him is that he was keeping a large number of activated and inactivated sim

Patna High Court CR. MISC. No.14631 of 2021(3) dt.09-09-2021 2/3 cards. The police has recovered sim cards, laptop, mobile and cash which are found in suspicious condition allegedly used in cheating the people.

Learned counsel submits that the allegations are false and baseless. The petitioner has remained in custody for 11 months, investigation against him is complete, thus, he may be released on bail.

Mr. Ram Sevak Chaudhary, learned APP for the State has though opposed the prayer for regular bail of the petitioner, however, considering that the petitioner has got no criminal antecedents and he has remained in jail for 11 months in connection with this case, investigation against him is complete, this Court directs that the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Giriyak (Katrisarai) P.S. Case No.378/2020, subject to the condition as laid down under Section 437 (3) Cr.P.C.

And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal

However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
