The petitioner seeks bail in a case under section 376,511 of the Indian Penal Code and Section 7 of the POCSO Act.

The victim made allegation that the petitioner entered into her house and made an attempt to commit rape upon her.

It is submitted that the petitioner is in jail since 03.09.2014.

Learned counsel for the informant states that the petitioner has got criminal antecedent and he is an accused in Sultanganj P.S. Case no. 207 of 2013 registered under sections 448, 341, 323, 504, 506, 427, 354/34 of the Indian Penal Code.

Patna High Court Cr.Misc. No.23770 of 2015 (2) dt.10-07-2015 The trial is likely to be concluded in near future and only two witnesses are to be examined.

Considering the fact that the petitioner has got criminal antecedent and he is an accused in a case of similar nature, I am not inclined to enlarge the petitioner on bail in connection with Sultanganj P.S. Case no. 102 of 2014, Special Case No. 17 of 2015 pending in the court of the learned Additional Sessions Judge Ist, Patna. This application for bail stands rejected. The trial court is directed to expedite the trial and conclude the same within three months from the date of receipt/production of a copy of this order.
