JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-04-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 02.12.2015 passed in Cr. Misc. No. 48174 of 2015 on the ground that the petitioner is in custody since 07.11.2014 and there is no progress in the case and in near future the trial is not likely to be concluded, to which the learned A.P.P. opposes by submitting that the petitioner is the assailant.
In the facts and circumstances as stated above, finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Behiya P.S. Case No. 255 of 2014 pending in the court of the learned Chief Judicial Magistrate, Bhojpur, Ara.
Patna High Court Cr.Misc. No.16395 of 2016 (2) dt.13-04-2016 2/2 However, considering detention of the petitioner, let the trial be expedited and concluded preferably within nine months.
