The petitioners seek regular bail in connection with Laxmipur P.S. Case No.302 of 2017 for the offences punishable under Section 395, 397/ 34 of the Indian Penal Code. The allegation is regarding unknown miscreants having entered the house of the informant and having looted various articles. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. No recovery has been made from the petitioners and in fact their names have transpired on the basis of the confessional statement of the coaccused persons. It is further submitted that the petitioner No.1 is having five criminal cases against him whereas the petitioner No.2 is accused in ten other cases, however, they are stated to be on bail in all the said cases and for this reason, the learned counsel for the
Patna High Court Cr.Misc. No.5257 of 2019(2) dt.30-01-2019 2/2 petitioner submits that the petitioner is ready to comply with any condition which this Court may deem fit and proper to be imposed for the purposes of grant of bail. Petitioner is languishing in custody since 10.07.2018.
Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Jamui, in connection with Laxmipur P.S. Case No.302 of 2017 In view of the fact that the petitioners are accused in other cases under different Sections of the Indian Penal Code, I deem it fit and proper to direct that the petitioners shall mark their attendance before the concerned police station on every Monday of the week at 10 A.M. and co-operate in the investigation. The failure of the petitioners to mark attendance before the concerned police station on two consecutive Monday's of the week at 10 A.M. shall result in cancellation of the present privilege of bail automatically and the petitioners would be taken into custody forthwith.
