JUSTICE SUDHIR SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case registered under Sections 323, 363, 328 of the Indian Penal Code. It is alleged by the informant, Soni Devi, that on 27.9.2015 the petitioner in collusion with other co-accused persons kidnapped her son, Niraj Kumar, aged about three years after drinking of Pepsi leading to her senseless and assaulting her from the Chabutara of Pakarideyal Hospital on pretext of visiting fair.
It is submitted on behalf of the petitioner that the petitioner is in custody since 27.12.2015. Charge sheet has been submitted in this case. The FIR has been instituted on 9.10.2015. Delay has not been explained by the prosecution.From perusal of
Patna High Court Cr.Misc. No.17110 of 2016 (4) dt.24-05-2016 2/2 para 43 of the case diary it is evident that the victim boy has already been recovered.
On behalf of the State, it is submitted that the petitioner is named in the FIR.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikrahna at Dhaka, East Champaran arising out of Pakridayal P.S.Case No. 135 of 2015.
