1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Arwal P.S. Case No. 504 of 2023 dated 01.10.2023 registered for the offence(s) punishable under Section(s) 419, 420, 467, 468, 120B and 414 of the Indian Penal Code and Section 66D I.T. Act and section 3 of Bihar Conduct of Examination Act.
3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner has got no criminal antecedent and has been languishing in jail since 02.10.2023 and he is a young person and as per allegation, he was arrested from a Hotel with one co-accused Rakesh Kumar but from his possession no incriminating material except some mobile phones and a walky-talky was recovered and several co-

No.7720 of 2024(2) dt.19-02-2024 2/3 accused persons carrying more serious allegations, namely Pintu Kumar @ Chotu, Vikash Kumar and Ajit Kumar have been granted bail by co-ordinate benches of this court vide orders passed in Cri. Misc. No. 3889 of 2024, Cri. Misc. No. 3747 of 2024 and Cri. Misc. No. 6612 of 2024 and the co-accused Rakesh Kumar carrying similar nature of allegation who was apprehended along with this petitioner has also been granted bail by a co-ordinate bench of this court vide order passed in Cri. Misc. No. 6778 of 2024. Further submissions are that petitioner himself was a candidate in the Bihar Constable Recruitment Examination and for appearing in the said examination he was staying in a hotel but he was apprehended by the police on account of misunderstanding and against him, the investigation has been completed.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. Considering the above submissions and mainly the privilege of bail having been granted to several co-accused persons mentioned above by co-ordinate benches of this court and coupled with the petitioner's young age and completion of investigation against him and his fair and clean antecedent, this court is inclined to accept his bail prayer.
