JUSTICE SUDHIR SINGH ORAL ORDER 19-08-2015 The petitioner is languishing in custody since 21.02.2015 in connection with Begusarai Bakhri (Parihara) P.S. Case No. 41 of 2015 for the offences instituted under Sections 420, 467, 468, 471, 109, 115, 308 and 120(B) of the I.P.C.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that on 17.02.2015 about 3.00 P.M. the informant received message through S.P., Begusarai, on telephone to the effect that noted criminal of locality in the jurisdiction of the said police station making preparation for committing serious offences which is known by D.I.V. established in his office through voice lager machine through mobile phone number of veteran criminal Ravi Jha that the petitioner Manoj
Patna High Court Cr.Misc. No.24680 of 2015 (3) dt.19-08-2015 2/3 Tanti is in contact with veteran criminal Ravi Jha through Gulab Singh with conspiracy to kill Amit Kumar Deo, Up Pramukh Bakhari Sub-Division for satisfaction of political rivalry and previous enmity. In this connection, Amit Kumar Deo gave a written petition on 19.02.2015 in Parihari O.P. alleged therein that the petitioner Manoj Tanti is attempting to kill him with other persons and any time occurrence may be happened with him. On 21.02.2015 at 9.00 A.M., the informant reached the house of petitioner Manoj Tanti and seized his mobile with two Sims, one Sim was in his name and other Sim in the name of other person.
On interrogation, petitioner Manoj Tanti conceded that he is in contact with other co-accused Gulab Singh through mobile phone to kill Amit Kumar Deo by veteran criminal Ravi Jha group on Two Lac Rs. and advance Rs. 20,000/- is already given to Ravi Jha but he demanded more Rs. 30,000/- before committing crime, then the informant reached the house of Gulab Singh with the petitioner Manoj Tanti and seized his mobile phone, on interrogation he disclosed that the petitioner Manoj Tanti is in contact with him to kill Amit Kumar Deo by Ravi Jha group and Rs. Two Lac is fixed for this act and also conceded that he is also in touch with Ravi Jha who is in Bardh Jail for this act.
Patna High Court Cr.Misc. No.24680 of 2015 (3) dt.19-08-2015 3/3 petitioner is in custody since 21.02.2015 and the charge sheet has been submitted in the present case. It is further submitted that there is no evidence against the petitioner except that a suspicion is being raised that he was also one of the conspirators. It is further submitted that the petitioner may be released after completion of nine months in custody from 21.02.2015.
On behalf of the State and the informant it has been submitted that the petitioner has got criminal antecedent and he is involved in five other criminal cases.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of nine months in custody from 21.02.2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, in connection with Begusarai Bakhri (Parihara) P.S. Case No. 41 of 2015.
