The petitioner is accused in connection with Amarpur P.S. Case No. 231 of 2015, registered under Sections 147, 148, 149, 323, 324, 307, 504 and 506 of the Indian Penal Code, Section 27 of Arms Act and Section 3/4 of Explosive Substance Act.
The accusation is that 08 accused named in the F.I.R., including the petitioner, entered in the house of the informant Uttam Kapri and started to abuse. At that time, petitioner gave iron rod blow at his leg. Thereafter, Pankaj Kapri, Vivek Kapri, Vikram Kapri and this petitioner caused assault to the informant through lathi, when Brahdeo Kapri
Patna High Court Cr.Misc. No.17764 of 2016 (2) dt.29-04-2016 2/2 rushed to save the informant, then he was shot fire by Ajay Kapri, but the same could not hit to him and at that time Pankaj Kapri gave Khanti blow at his head.
Learned counsel for the petitioner submits that there is land dispute in between the parties. Moreover, the allegation against the petitioner is that he assaulted on the leg of the informant. Further submission is that petitioner having no criminal antecedent is in custody since 09.02.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 231 of 2015.
