The petitioners are languishing in custody since 26.03.2015 and 19.03.2015 respectively in a case registered for the offences punishable under Section 395 of the Indian Penal
Patna High Court Cr.Misc. No.24536 of 2015 (2) dt.21-07-2015 2/2 Code. Subsequently, section 412 of the IPC was also added. On robbery of the informant's jewellery, cash and mobile the FIR was lodged against three named and 10-12 unknown. The petitioners are not named in the FIR. Name of the petitioners sprang up during investigation.
Statements have been made in pagraph 7 of both the petitions that the petitioners have not been put on TIP and similarly situated co-accused persons have been granted bail vide Cr. Misc. Nos. 26424 of 2014, 27428 of 2014, 27921 of 2014 and 32063 of 2014.
Statements have been made in paragraph 3 of both the petitions that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari at East Champaran in connection with Turkauliya (Banjariya) P.S.
