JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 324, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is said to have opened fire causing firearm injury on the right leg of the informant. The doctor, who examined the injured just after the alleged occurrence, found two injuries on right lower limb of the injured and observed that the aforesaid injuries were simple in nature. The concerned doctor issued injury report on 23.08.2015 and again on 15.09.2015 he gave another injury report pointing out that aforesaid injuries were caused by pointed and hard weapon. Patna High Court Cr.Misc. No.17925 of 2016 (5) dt.09-09-2016 2/2 jail custody since 15.09.2015 and does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Samastipur in connection with Sessions Trial No. 41 of 2016 arising out of Chakmehsi P.S.
