JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 21-05-2015 The petitioner has renewed his prayer for bail in connection with Sessions Trial No. 327 of 2014, arising out of Town Motihari P.S.Case No. 123 of 2006, registered for the offences punishable under sections 366, 384 and 120B read with 34 of the Indian Penal Code.

His prayer for bail was earlier rejected by this Court vide order dated 20th March, 2014 passed in Cr. Misc. No. 48637 of 2013 with a direction to the court below to hold the trial expeditiously.

It has been contended that till date only seven out of ten charge-sheeted witnesses could be examined on behalf of the prosecution during trial and there is no likelihood of conclusion of

Patna High Court Cr.Misc. No.24214 of 2015 (2) dt.21-05-2015 2/2 trial in near future.

Be that as it may, regard being had to the reasons assigned in the earlier order dated 20th March, 2014, I am not inclined to grant bail to the petitioner for the present. However, if the trial is not concluded within seven months from today, the petitioner would be at liberty to renew his prayer for bail before the court below itself.
