JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act.

One country made loaded pistol is said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 21.12.2015 and prior to institution of the present case, only one case for the offence under Section 379 of the Indian Penal Code had been lodged against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.14928 of 2016 (2) dt.11-04-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni (Chakia) P.S. Case No. 455 of 2015.
