The petitioner, who is in custody since 18th April, 2014, seeks bail in connection with Daudnagar P.S. Case No. 102 of 2014 registered under Sections 25(1-B)(a), 26 and 35 of the Arms Act as also Section 17 of the Criminal Law Amendment Act.
The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 12.11.2014 passed in Cr. Misc. No. 40745 of 2014 with observation that if the trial is not concluded within six months, the petitioner would be at liberty to renew his prayer for bail.
According to the prosecution case, one country-made
Patna High Court Cr.Misc. No.25156 of 2015 (2) dt.01-07-2015 2 / 2 loaded pistol and one live cartridge were recovered from possession of the petitioner.
It has been contended that till date there is no progress in the trial.
Regard being had to the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No. 102 of 2014.
