JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 363/366A/34 of the Indian Penal Code. The victim has already returned home and her statement under Section 164 of the Cr.P.C. was recorded. The victim stated that she was forcibly taken away by one Sajan with the help of the petitioner and co-accused Umesh Singh. The informant claims that at the time of kidnapping, petitioner and Umesh Singh were caught on the spot. Moreover, co-accused Umesh Singh @ Umesh Kumar has already been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court whereas petitioner is languishing in jail custody since 10.2.2016.
