Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 307 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is named in the first information report but according to the prosecution case itself, it was co-accused Sanjay Gop, who opened fire on the informant causing fire arm injury to him. So far as petitioner is concerned, there is no specific overt act against him.

No.14441 of 2016 (2) dt.07-04-2016 2/2 No doubt, petitioner carries criminal antecedent of near about four cases, but considering the facts and circumstances of the present case as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Nalanda at Biharsharif in connection with Bihar P.S.
