The petitioner seeks bail in Sarairanjan P.S. Case No. 115/2018, instituted for offences under Section(s) 120B, 302 and 201/34 of the Indian Penal Code.

It is alleged in the written report that daughter of informant was married with this petitioner in the year 2002. She had a son, aged about 12 years and a daughter aged about 8 years. After two years of marriage, daughter of informant had altercation with petitioner because he had developed illicit relationship with his Bhabhi. Petitioner used to assault the daughter of informant when she made protest, for which Panchayati had taken place. It is alleged that on the date of occurrence at about 7:30 A.M. informant got information that

Patna High Court CR. MISC. No.466 of 2019(3) dt.08-03-2019 2/3 one dead body of a married lady has been recovered in Muri Sarairanjan, who looks like the daughter of informant. Thereafter informant went to the house of his daughter but he did not find anybody in the house. He learnt that police has taken the dead body of deceased for post-mortem. The informant identified the dead body to be of his daughter on the basis of ring and payal on the body of deceased. After recovery of dead body inquest report was prepared by the police. Case diary has been received.

It is mentioned in inquest report in para 3 of case diary that dead body of unknown married lady aged 18 years was found lying in a filed behind Sarairanjan Cinema. As per written report the deceased was mother of a son aged 12 years and daughter aged 8 years. There is no specific allegation against the petitioner of committing murder of his wife. Petitioner has been made accused only on the basis of identification of aforesaid dead body by the informant during post-mortem on the basis of payal and ring.

Learned counsel for the informant has opposed the prayer for bail of petitioner. He has submitted that informant has identified the dead body of his daughter during post-mortem. Petitioner is in custody since 23.07.2018.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIth, Samastipur, in connection with Sarairanjan P.S.
