JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 324, 307 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner happens to be own younger brother of the informant and it is alleged that he opened fire on the informant as a result of which informant sustained firearm injury on his right hand but submission on behalf of the petitioner is that on the alleged date of occurrence the informant and his supporters assaulted the father of the petitioner for which the father of the petitioner lodged Uphara P.S. Case No. 50 of 2015 against the present informant. It is further submitted that moreover, the
Patna High Court Cr.Misc. No.16187 of 2016 (2) dt.22-04-2016 2/2 informant sustained simple injury said to be caused by hard and blunt substance.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri K.K. Shukla, Judicial Magistrate 1st Class, Daud Nagar, Aurangabad in connection with Uphara P.S. Case No. 52 of 2015. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
