JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-04-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. Petitioner is aggrieved by the order contained in Memo No. 922 dated 02.07.2018 (Annexure-4) whereby he has been put under suspension with immediate effect. Learned counsel for the petitioner submits that till date departmental proceeding has not been initiated against the petitioner.

Patna High Court CWJC No.4182 of 2021(2) dt.07-04-2021 2/2 Considering the fact that the petitioner is under suspension since 02.07.2018, the writ application is disposed of with a direction to the respondents to conclude the departmental proceeding within a period of four months from the date of receipt/production of a copy of this order failing which the order of suspension shall automatically stand revoked and the petitioner shall be entitled to reinstatement and payment of salary for the period of suspension.

With the aforesaid, the present writ application stands disposed of.
