By filing a petition under Order 6 Rule 17 CPC, the petitioner-plaintiff sought amendment in the decree which the learned court below has rejected vide impugned order dated 2.11.2021 holding that the amendment sought is not permissible and the decree cannot be amended under Order 6 Rule 17 CPC
Patna High Court C.Misc. No.48 of 2022(2) dt.23-06-2022 2/2 inasmuch as the aforesaid provision in the statute is for amendment of pleading and the petitioner is not seeking the amendment in the pleading.
In view of the finding arrived at by the learned executing court, the impugned order is not erroneous and there is no material irregularity or jurisdictional error in the impugned order.
