JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 Petitioner apprehends his arrest in connection with Bakhari P.S. Case No. 159 of 2016 registered for the offences punishable under Sections 341, 323, 354, 376/511 and 379 of the Indian Penal Code.
Allegation against the petitioner is of attempting to commit rape upon the informant.
Submission of learned counsel for the petitioner is that earlier in the year 2012 wife of petitioner has lodged a case against the informant and Sessions Trial is going on, due to that in order to create pressure upon the petitioner the present case has been lodged.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.1156 of 2019(2) dt.17-01-2019 2/2 circumstances, let petitioner, above named, surrender within a period of six weeks from the receipt of this order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Bakhari P.S. Case No. 159 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in investigation, otherwise his bail bond shall be cancelled.
