JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 7.02.2016 in a case initially registered under section 302 /34 of the Indian Penal Code but after investigation, police submitted charge sheet against the petitioner and her husband for the offences punishable under section 302/34 of the Indian Penal Code.

It would appear from perusal of the first information report that an altercation took place between the parties on a petty issue and in that altercation, the family members of informant were assaulted and when the deceased came to their rescue, he was too assaulted and it was co-accused Vijay Mandal, who gave fatal blow on the chest of the deceased. So far as petitioner is

Patna High Court Cr.Misc. No.15713 of 2016 (2) dt.19-04-2016 2/2 concerned, she happens to be woman and is languishing in jail custody since long and her further detention is not required and the investigation has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Samastipur in connection with Hathauri P.S.Case No. 74 of 2015.
