2. The petitioner is in custody in connection with Sessions Trial No. 534 of 2024 arising out of Darauli P.S. Case No. 214 of 2024 for the offence punishable under sections 103, 109, 3(5) of BNS and Section 27 of Arms Act lodged on 15.07.2024 by the informant, Osear Ansari.
3. Learned counsel for the petitioner submits that though specific allegation is against him, the fact remains that the narration of FIR is quite different from the actual occurrence and to implicate, he has been named.
4. Learned APP, on the other hand, has taken this Court to the FIR to show that specific allegation is against this petitioner that he opened fire causing injuries to the victim
Patna High Court CR. MISC. No.4260 of 2025(2) dt.19-03-2025 2/2 which proved fatal.
5. Taking into account the allegation that has come against the petitioner, the facts of the FIR is/are disturbing as to how such kind of occurrence can take place and people resort to such extremity resulting into the deaths.
6. No case of bail is made out, dismissed.
7. In view of the fact that the petitioner is in custody since 17.07.2024, the learned Trial Court is requested to expedite the trial and see to it that it is concluded within a year subject to co-operation of the accused/prosecution. (Rajiv Roy, J) Vijay Singh/- U T
