The petitioners seek bail in anticipation of their arrest in connection with Sahargaht P.S. Case No. 59 of 2018 dated 25.04.2018 instituted for the offences under Sections 147, 148, 149, 447, 341, 323, 324, 327, 302, 354 and 379 of the Indian Penal Code.
15 accused persons including the petitioners are named in the FIR. The FIR indicates that the accused persons entered the house of the informant and indulged in assault. So far as the petitioners are concerned, they are not alleged to have assaulted the informant or for that matter anybody. The petitioners along with another is said to have snatched away the golden chain from the informant. The niece of the informant later succumbed to the injuries. One of the accused persons having

No.322 of 2019(2) dt.29-01-2019 2/2 similar allegation i.e. of snatching away gold ornament from the person of the informant has been granted anticipatory bail by a coordinate bench of this Court. Since the petitioners are only named in the FIR as members of the mob and have not been attributed with any overt act as well as taking into account the background of enmity and their clean antecedents, they are are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Saharghat P.S. Case No. 59 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
