The petitioner apprehends his arrest in connection with Rajoun P.S. Case No. 97 of 2017 registered for the offence under Sections 366(A) and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, there was love affairs between the petitioner and the victim and out of her sweet will the victim has performed marriage with the petitioner. Moreover, the victim, who is major, in her statement recorded under Section 164 Cr.P.C. has admitted that she has performed marriage with the petitioner and she has been living with him since long. There no case under Section 366(A) of the Indian Penal Code is made
Patna High Court CR. MISC. No.4062 of 2020(3) dt.23-06-2020 2/2 out against the petitioner. Hence, the petitioner deserves the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioner, above named, in the even of his arrest or surrender within a period of four weeks from today, be released on anticipatory bail on furnishing his personal bond to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S.
