2. The petitioner apprehends his arrest in connection with Sahiyara P.S. Case No. 76/2021 for the offence registered under sections 392/411 lodged on 11.06.2021 by the informant Shiv Shankar Kumar.
3. As per the prosecution story, the informant alleged that for purchase of articles in Sitamarhi, he had Rs. 2 lakhs in cash while his brother was having 1.5 lakhs in a polythene and as the motorcycle reached near the bridge, the motorcycle borne accused came and on the point of pistol took away the amount. Accordingly, the FIR.
4. Learned counsel for the petitioner submits that there is no recovery from him, in Course of investigation one
Patna High Court CR. MISC. No.6093 of 2024(3) dt.16-04-2024 2/2 Priyanka Kumari was arrested and on her confession, his name has cropped up.
5. Learned APP for the State, on the other hand, points out that he is an accused under Section 414 of the Indian Penal Code as also other sections in connection with Sonbarsa P.S. Case No. 217 of 2020.
6. Considering the aforesaid facts and in the background that he has criminal antecedents, it is a broad day robbery of Rs. 3,50,000/-, it would be appropriate that the petitioner seeks bail.
