Let it be taken on record.
The affidavit filed today reflects that the dispute has been resolved on the following terms: The amount of the cheque which has been dishonoured viz. Rs. 72000/- has been paid by the petitioner to opposite party no. 2 which has been acknowledged by him by giving a receipt of the same. A further sum of Rs. 8000/- has been paid
Patna High Court CR. MISC. No.2567 of 2019(6) dt.17-07-2019 2/2 by the petitioner to opposite party no. 2, which payment also has been acknowledged by a receipt. The opposite party no. 2, in turn has agreed not to pursue the Complaint Case C-63/2017 pending before the learned Sub-Divisional Judicial Magistrate, Raxaul, East Champaran.
Learned counsel for the petitioner submits that the aforesaid arrangement has been made without any fear or favour and only for the purposes of ending the litigation.
For the facts stated above and relying upon the joint affidavit, the order of cognizance dated 22.07.2017 in connection with Complaint Case No. C-63 of 2017 is quashed. All further prosecution arising therefrom are also quashed.
The application stands allowed.
