The petitioner seeks bail in Bajpatti P.S. Case No.133 of 2013 instituted for the offences under Sections 147, 148, 149, 341, 302 and 379 of the Indian Penal Code. This Court has called for a report from the trial court and the same has been received.
From perusal of the report it appears that all witnesses have already been examined and case is fixed for recording statement of accused persons under Section 313 of the Code of Criminal Procedure.
The trial court is directed to conclude the trial within a period of four months from the date of
Patna High Court Cr.Misc. No.16210 of 2016 (4) dt.22-06-2016 receipt/production of a copy of this order and if the case is disposed of within the aforesaid period the trial court will submit a report.
In this view of the matter, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected.
