The petitioner is accused in connection with Naubatpur P.S. Case No. 113 of 2012, registered under Section 302/34 of the Indian Penal Code.
The accusation is that at the time of occurrence Rupesh Kumar gave Bhala blow at the left orbital of Chhotan Sharma, father of the informant, whereas the petitioner gave Garasa blow in which he fell down thereafter all the accused persons caused injury through Lathi and stick. Learned counsel appearing on behalf of the petitioner submits that while there is specific allegation against the petitioner to cause injury through Garasa at the chest of the deceased Chhotan Sharma and also by Bhala by Rupesh Kumar
Patna High Court Cr.Misc. No.9021 of 2016 (2) dt.18-03-2016 2/2 at the left orbital region, but only one penetrating injury was found on the person of the deceased. Further submission is that due to land dispute, the petitioner has been implicated in this case. The petitioner is in custody since 19.08.2012. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.VII, Danapur, Patna in connection with Naubatpur P.S.
