JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioner is in custody since19.3.2015 in connection with Special Case No.12 of 2015 arising out of Vigilance P.S. Case No.22 of 2015 for the offences instituted under Sections 7/13(2) read with Section 13 (1) (d) of the Prevention of Corruption Act.
Heard learned counsel for the petitioner and learned counsel for the Vigilance.
The prosecution story, in brief, is that the petitioner is said to have demanded Rs.10,000/- as a bribe for arresting the accused in Sahebganj P.S.Case no.405/14 and, accordingly, he was arrested read handed by trap team having Rs.10,000/- in his hand.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.24383 of 2015 (5) dt.12-08-2014 2/2 petitioner is in custody since 19.3.2015 and the charge sheet has submitted in the present case. It is further submitted that the petitioner has been made accused due to mistake of fact. The petitioner is ready to deposit an amount of Rs.25,000/- in the court below which shall be subject to the final result of the case. On behalf of the Vigilance it has been submitted that the petitioner has been apprehended in the present case taking Rs.10,000/- as a bribe.
Considering the aforesaid facts and circumstances, the petitioner, above named, is directed to deposit an amount of Rs.25,000/- before the court below which shall be subject to the final result of the case and on his doing so, he shall be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance, 1st, Patna, in connection with Special Case No.12 of 2015 arising out of Vigilance P.S. Case No.22 of 2015.
