The petitioner is apprehending his arrest in connection with Kawakole P.S.Case No.154/18 dated 14.7.2018 , registered for offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

Allegation against the petitioner is of assault to the informant by lathi and danda causing injury to him. Submission of the learned counsel for the petitioner is that there is case and counter case and one of the injuries are simple in nature and the opinion on the rest of the injuries was kept reserved but that is not on the vital part of the body. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named,

Patna High Court Cr.Misc. No.84 of 2019(3) dt.21-02-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Nawada in connection with Kawakole P.S.Case No.154 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
