JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-05-2015 Petitioner is languishing in custody since 13.02.2015 in a case registered for the offences punishable under Sections 379, 411, 420 of the Indian Penal Code. It is alleged against the petitioner that by offering help to the informant, the petitioner withdrew Rs. 10,000/- from the A.T.M of the informant but did not hand over the said money. The petitioner withdrew same amount of the money through the A.T.M of one Neeraj Kumar Chaudhary but the petitioner was apprehended on the spot and from his possession A.T.M cards of different banks of different persons and cash of Rs. 10,000/- were recovered.

It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been apprehended by the police. Moreover the investigation has already concluded.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur in connection with Madhepur P.S. Case No. 09 of 2015.
