Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 28-05-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing in view of the lock-down on account of COVID-19 pandemic.

In this case, the petitioner is seeking regular bail in connection with Singeshwar P.S. Case No.123 of 2019 registered for offence punishable under sections 323, 341, 324, 307, 379, 504 and 506/34 of the Indian Penal Code. There is an allegation against the petitioner and others to have assaulted the victim by different traditional weapons, i.e. iron rod causing head injury.

Learned counsel for the petitioner submits that rest of the accused have already been granted bail by the court below itself and the petitioner is in jail since 04.12.2019.

No.3669 of 2020(3) dt.28-05-2020 2/2 Looking to the facts and circumstances of the case, the petitioner, named above, is directed to be released on regular bail on his personal bond to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 123 of 2019, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. In case of failure, the bail granted to the petitioner will be treated to have been withdrawn. This order has been passed in presence of the counsel for the State, Binod Kumar No.3.
