2. The present application has been filed seeking initiation of contempt proceeding against the opposite parties for their willful and deliberate disobedience of the order of this
Patna High Court MJC No.274 of 2025 dt.19-06-2026 2/3 Court dated 30.07.2024 passed in C.W.J.C. No. 3374 of 2022.
3. Learned Advocate for the petitioner submits that in compliance with the direction of this Court to ensure payment of differential amount of 5th/ 6th Pay Revision as well as provident fund to the petitioner, it has been paid only with effect from July, 2024, though the petitioner retired on 30.06.2016.
4. Learned Advocate for the Municipal Corporation submits that since the Corporation has taken a conscious decision to extend such benefit uniformally to all its retired employees with effect from July, 2024, accordingly, the admissible payment has been accorded to the petitioner.
5. Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the fact that the petitioner has already been paid the arrears of difference of salary and pension on account of 5th / 6th Pay Revision, this Court does not find any reason to continue with the present proceeding. Accordingly, the same stands closed.
6. However, if the petitioner is aggrieved with respect to the arrears of salary/pension for the interregnum period, he shall be at liberty to file application and the same shall be considered by the authority concerned and necessary
