The petitioner is apprehending his arrest in connection with Shyampur Bhatahan P.S.Case no.123 of 2018 (G.R.No.1029 of 2018) , registered for offences punishable under Sections 30(A) of Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is about recovery of 180 ml. of liquor from the house of the co-accused and he disclosed the name of the petitioner as supplier.

Submission of the learned counsel for the petitioner is that nothing has been recovered from his house or from the conscious possession as well as he has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.1279 of 2019(2) dt.18-01-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge cum Special Judge II, Sheohar in connection with Shyampur Bhatahan P.S.Case no.123 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case.. With the aforesaid observation, this application is allowed.
