The petitioner apprehends his arrest in Hasanpur P.S. Case No. 48 of 2020, registered for the offences punishable under Section 392 of the Indian Penal Code.

Prosecution case in brief is that on the alleged date and time of occurrence, while the informant was returning to his home, on the way two unknown miscreants riding on motorcycle, surrounded him and snatched away cash and mobile from his possession.

It is submitted that petitioner is not named in the FIR, Name of petitioner transpired during course of investigation on the basis call detail report (CDR) in which the location of mobile of petitioner was found near the place of occurrence on

Patna High Court CR. MISC. No.5116 of 2022(2) dt.28-07-2022 2/2 the alleged date and time. There is no other material which show involvement of this petitioner in the alleged occurrence. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Rosera, Samastipur in connection with Hasanpur P.S. Case No. 48 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
