JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are in jail custody since 02.03.2016 in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code. There is accusation against the petitioners that they assaulted the informant and his family members and committed loot in his house.
Contention on behalf of the petitioners is that petitioners are agnates of the informant and as a matter of fact, a quarrel took place between the parties due to land dispute and the prosecution party also assaulted the family members of the
Patna High Court Cr.Misc. No.16202 of 2016 (2) dt.22-04-2016 2/2 petitioners for which a criminal case was lodged. It is further submitted that moreover, persons from both the sides sustained injury and, therefore, even if it assumed that some injured of the present case sustained grievous injury, then also, it is a case of free fight in which both parties sustained injuries. It is further contended that one co-accused, Madhukant Singh has already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Alamnagar P.S.
