JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-01-2020 Petitioner seeks bail in connection with Special Case No. 5740 of 2019, arising out of Salimpur P.S. Case No. 125 of 2019, registered for the offences punishable under Section 498A of the Indian Penal Code and Sections 37 (b)(c) of Bihar Prohibition and Excise Act.

Prosecution case is that petitioner is said to have assaulted his wife and children in drunken condition. Submission of learned counsel for the petitioner is that he has already remained in custody for seven months, charge sheet has been submitted, as such there is no chance of tampering with the evidence.

Heard learned APP also.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.3555 of 2020(2) dt.28-01-2020 2/2 Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Special Case No. 5740 of 2019, arising out of Salimpur P.S.
