The petitioner seeks bail in connection with Rajoun P.S. Case No. 339 of 2023 instituted for the offence under Sections 302, 120(B) and 34 of the Indian Penal Code and 27 of the Arms Act.

As per the prosecution case, the petitioner along with other accused persons connived with the main accused Mehtab Alam committed murder of the son of the informant. 4.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.10.2023. Petitioner is stated to be man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. He further submits that there is no specific allegation

Patna High Court CR. MISC. No.6452 of 2024(2) dt.13-02-2024 2/2 against the petitioner rather the specific allegation of shot at the deceased is against the co-accused namely, Mehtab Alam. Similarly situated co-accused has also been granted bail by Coordinate Bench of this Court vide order dated 08.12.2023, passed in Cr. Misc. No. 78540 of 2023.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case as well as period of custody, general and omnibus allegation allegation against the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Rajoun P.S. Case No. 339 of 2023.
