JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 This application, for grant of anticipatory bail, arises out of Jagdishpur P.S. Case No. 327/2018, disclosing offences under Sections 302, 201, 34 of the Indian Penal Code. Petitioner happens to be mother in law of the deceased and the allegation against her and others is that the marriage of the deceased was solemnized with the elder son of the petitioner, who died and, thereafter, the marriage of the deceased daughter of informant was solemnized with the second son of petitioner, who after marriage started pressurizing to perform marriage with the second daughter of the informant and on protest, the deceased was done to death.
Submission of learned counsel for the petitioner is that the deceased died due to accidental fall on the roof top and the allegation of killing the daughter of informant is false and
Patna High Court Cr.Misc. No.2199 of 2019(2) dt.16-01-2019 2/2 concocted. Further submission is that the petitioner is mother in law of the deceased and the husband of the deceased is already in judicial custody.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned I/c Additional Chief Judicial Magistrate -XI, Bhojpur, Ara, in connection with Jagdishpur P.S. Case No. 327/2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
