The petitioners have approached this Court seeking a direction upon the respondent authorities to provide identical pay scale as has been accorded to the similarly situated persons, namely, Alakh Kumar Sinha and Rajesh Kumar in view of the order dated 09.03.2007 passed in CWJC No. 12301 of 2004, which order was duly affirmed in the LPA No. 878 of 2007 and further the Civil Review No. 209 of 2012 filed by the State also came to be dismissed.
3. Learned Advocate for the petitioner contended that the petitioners were initially appointed as Industry Extension Officer, and now some of them have already superannuated. Drawing the attention of this Court to the gradation list of Industry Extension Officer as notified vide memo no. 4852
6/8 dated 07.09.1995 issued by the Industries Directorate, Government of Bihar, it is contended that the petitioners are identically situated to Alakh Kumar Sinha and Rajesh Kumar whose names have been also placed alongwith the petitioners in the gradation list.

On being deprived by the admissible pay scale, the identically situated persons approached this Court in CWJC No. 12301 of 2004, which came to be disposed off on 09.03.2007, with a direction upon the respondents to revise the pay scale of those persons. Against the said order, the State preferred Letters Patent Appeal, as well as Civil Review, which also came to be dismissed.

Subsequent thereto, the similarly situated persons have been compelled to file contempt petition and thereafter a decision has been taken at the level of the concerned department and they have been allowed the revised scale of Rs. 1600/- to 2780/- and further corresponding pay scale of Rs.5000/- to 8000/- with effect from 01.01.1996. However, discrimination has been caused and the petitioners have been deprived from the identical pay scale, compelling them to approach before the concerned authorities by filing innumerable representation, but to no avail and, as such, the petitioners are before this Court.
6. Learned Advocate for the State submits that the entire case of the petitioners are based on parity and the same
7/8 are required to be examined by the concerned respondents.

Having considered the submissions advanced on behalf of learned Advocate for the parties, as also taking note of the nature of grievance, this Court deems it appropriate to dispose off the writ petition, with a direction to the respondent no. 4 to consider the claim of the petitioners for their admissible pay scale in terms of the notification issued by the Finance Department, Government of Bihar as contained in Memo No. 9803 dated 21.10.2011, as well as the order of this Court passed in CWJC No. 12301 of 2004 duly affirmed by the learned Division Bench of this Court and further the order issued by the Additional Director, Industries, Government of Bihar, Patna contained in Memo No. 4190 dated 18.11.2021.

It is further clarified that if claim of the petitioners is found identical to Alakh Kumar Sinha and Rajesh Kumar, who were the parties to CWJC No. 12301 of 2004, identical relief should be accorded to the petitioners in terms of the clause 4C of the Bihar Litigation Policy, 2011, as well as, the mandate of the Apex Court in the matter of Lt. Col. Suprita Chandel vs. Union of India & Ors., in Civil Appeal No. 1943 of 2022 preferably within a period of 12 weeks from the date of receipt/production of a copy of this order.
