The petitioner seeks bail in Sohsarai P.S.Case No.80 of 2018 registered under Sections 395, 412 of I.P.C. The informant has alleged in his written complaint that when in the night of 2.4.2018 at 1.15 P.M. he along with his wife were sleeping in room six unknown miscreants entered into the room after breaking door and putting pistol on him demanded key of godrej almirah and they tied the hands and feet of the informant and his wife and took away his rifle kept in the almirah, ornaments and cash Rs.60,000/- to Rs.70,000/-.They also ransacked the house of the informant. It is further alleged that the Hand Disk of C.C.T.V. fitted in the house of the informant was also taken away.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.6151 of 2019(4) dt.29-03-2019 2/2 petitioner has been falsely arrested from other place and much after the occurrence.

Learned A.P.P. has vehemently opposed the prayer for bail of the petitioner on the ground that the looted Rifle was recovered from the house of petitioner.

Looking to the facts and circumstances of the case I am not inclined to grant bail to the petitioner. The prayer for bail is rejected.

This application is,accordingly, dismissed.
