The petitioner seeks bail in connection with Hulasganj P.S. Case No.32 of 2015 for the offence punishable under Sections 323, 324, 307 and 379 read with Section 34 of the Indian Penal Code.

The prosecution story, in brief, is that on 25.04.2015 at about 9.30 A.M., there was some altercation between the parties in respect of construction of rack in the land of the informant and in the meantime, co-accused Gaurav Pandey assaulted the informant with iron road on his head and thereafter his father Nanhakur Sao and Ramanand Sao were also assaulted with axe and Khanti on the right knee and head by accused Bindu Pandey as well as by the petitioner, respectively. Patna High Court Cr.Misc. No.24670 of 2015 (2) dt.11-06-2015 2/2 inmates of the informant. It is further alleged that the petitioner took away golden chain from the neck of the informant. It has been submitted on behalf of the petitioner that it is a case and counter case between the parties and both sides have sustained injuries. The allegation for causing injury against the petitioner is that he caused injury by Tangi (axe) upon the father of the informant. The said injury is said to be simple in nature. On behalf of the State it has been submitted that the petitioner is named in the first information report. Considering the fact that the nature of injury caused by the petitioner is simple in nature, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Brajesh Mani Tripati, Judicial Magistrate, Ist Class, Jehanabad in connection with Hulasganj P.S. Case no. 32 of 2015.
