Mr.Anil Prasad Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Simra P.S. Case No. 37 of 2018 registered for the offence under Sections 302, 201/34 of the Indian Penal Code. Learned Counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent. He further submits that petitioner is Devar of the victim. He next contended that in the instant case police after investigation has submitted charge-sheet under Section 306 of the I.P.C.. Referring to Annexure-2 learned counsel for the petitioner would submit that the husband of the victim has sustained 40% burn injury which is indicative of the fact that he sustained burn injury while rescuing his wife.

No.4990 of 2019(2) dt.30-01-2019 2/2 Considering the fact that petitioner has no criminal antecedent and the husband of the deceased sustained 40 % burn injury in the incident, the Court is inclined to grant bail, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magisgtrate, Aurangabad in connection with Simra P.S. Case No. 37 of 2018.
