JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 This application, for grant of anticipatory bail, arises out of Obra P.S. Case No. 87/18, disclosing offences under Sections 304(B)/34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased and allegation against him is of causing dowry death of the deceased.

Submission of learned counsel for the petitioner that in fact that the deceased sustained burn injuries, while boiling the milk for her child and it is the petitioner, who took her to the PMCH for her treatment and in the occurrence, he also has sustained some burn injuries, which will appear from Annexure -2.

Learned counsel for the State opposed the prayer for bail on the ground that no such document is available in the case

Having heard both sides, considering the facts and circumstances and the nature of accusation, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
