JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2015 Petitioner being father of the husband of the victim is languishing in custody since 25.02.2014 in a case registered for the offences punishable under Sections 498A, 304B/34 of the I.P.C.

The accusation is killing the grand-daughter of the informant after three years of marriage for non-fulfilment of dowry demand.

It is submitted by learned counsel for the petitioner that since victim's relationship with her husband was not cordial, hence the victim committed suicide and the bona fide of the petitioner gets reflected from the fact that informant and the police were informed about the death by the petitioner. Though accusation has been levelled as omnibus and general. It is further submitted that with regard to torture and demand of dowry, no previous intimation was given to the police or any

It is submitted by learned counsel for the informant that petitioner being Karta of the family was responsible for the death of the victim as the medical opinion suggests the death caused by strangulation.

Considering the period under custody and the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Khirhar P.S. Case No. 15 of 2014. Learned Court below will positively cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during the trial.
