Petitioner has filed this writ petition for quashing letter no.1646 dated 14.11.2016 issued by Divisional Forest Officer-Licensing Authority, Supaul Forest Division, Supaul by which renewal of license of saw mill of the petitioner was rejected on the ground that in the seniority list, saw mill of the petitioner stands at serial no.43 and the license of saw mills, which stand at serial nos.1 to 41 in seniority list, are to be renewed.

It appears that the petitioner filed this writ petition and at the same time filed Appeal No.2s of 2018 before the Conservator of Forest, Purnea Anchal and the Conservator of

Patna High Court CWJC No.8456 of 2017(3) dt.27-02-2020 2/2 Forest by order as contained in Memo No.464 dated 23.05.2018 set aside the order as contained in Letter No.1646 dated 14.11.2016. In this view of the fact, I find that this writ petition has become infructuous as the order against which the petitioner filed this writ petition has already been set aside in appeal. Accordingly, this writ petition is dismissed as has become infructuous.
