====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-02-2026 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 356, 379 of the Indian Penal Code to which Section 411 IPC was added later on.

3. Prosecution case, in brief, is that on 02.12.2024 06.09.2020, motorcycle of the petitioner was stolen by three unknown miscreants and this petitioner is alleged to have purchased the aforesaid stolen motorcycle.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner has falsely been implicated in this case merely on the basis of confessional statement of co-accused Abhishek Kumar Jha. No looted article has been recovered from conscious possession of the petitioner. As a matter of fact, alleged stolen motorcycle was

Patna High Court CR. MISC. No.5595 of 2026(2) dt.04-02-2026 2/2 recovered from public place near pond. Petitioner has got no criminal antecedents of similar nature.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation and other facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- 1st, Dalsinghsarai, Samastipur in connection with Dalsinghsarai P. S. Case No. 257 of 2020, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
