====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 30-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Sessions Trial No. 672 of 2018 arising out of Chiraiya P.S. Case No. 122 of 2015, instituted for the offence under Section(s) 307, 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that petitioner is not named in the written report. He is in custody since 29.5.2018.

It is alleged in the written report that co-accused Washisht Narayan Tiwary, Surendra Kumar and three unknown persons opened fire in the chest of the informant causing injury to him. Thereafter, the accused persons fled away. The Sessions Judge has mentioned in the impugned

Patna High Court Cr.Misc. No.3585 of 2019(2) dt.30-01-2019 2/2 order that name of petitioner has transpired in the confessional statement of co-accused Vishwajit Kumar @ Pintu @ Bittu Tiwari.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 14th Additional Sessions Judge, Motihari, East Champaran, in connection with Sessions Trial No. 672 of 2018 arising out of Chiraiya P.S.
